"Suface Sample" and EVA-Report while flying can be obtained on a ladder.

Description
That EVA-Reports on a ladder results to Reports while flying was known but I discovered that they also can result into succesfully grabing a surface sample.

This misfeature has been around for some time, and might have been viewed as a harmless exploit until now. However, Kerbals can die, and there may be other unforeseen consequences.

In 0.90 I am no longer able to collect a surface sample while on a ladder. So at least part of this appears to have been addressed.
Curious how other players think the EVA report from a ladder should be handled.
Surface? I don't think this is correct. If so, then why not be able to collect a surface sample also?
Currently, the game considers an EVA report from a ladder on a landed vessel to be 'flying'. This doesn't seem quite right either, although collecting an EVA report from a vessel's ladder which is flying should be categorized as a 'flying' EVA report.
Do we need a new EVA report category of 'Landed, but not quite on the surface'?

Kerbals must now be in contact with the ground to take a surface sample. They can however remain attached to the ladder.
